Avoiding conflicts of interest: Acc. to sec. 45 BRAO no Attorney is allowed to accept a mandate, he previously delt with as a Notary, no Notary is acc. to sec. 3 para. 1 No. 7 BeurkG allowed to notarize, if he or one of his colleagues was involved in exactly the same matter as an attorney. In order to avoid such collisions, name registers must be kept and checked before taking on any mandate.

Dispute settlement: There is an arbitration order from the Hamm Bar Association (Free arbitration in property law disputes due to an alleged poor performance of the lawyer's contract from an existing or terminated client relationship). Since 2013 there has also been an arbitration option at the Federal Attorneys chamber and since 2016 for extrajudicial online dispute resolution if there is an online established contractual relationship, this EU-Platform. I am ready to participate in dispute settlement procedures at one of these arbitration boards.

Administrative district as a Notary:

My administrative district as a notary is identical to the district of Essen-Borbeck local court, containing Essen suburbs Bedingrade, Bergeborbeck, Bochold, Borbeck-Mitte, Dellwig, Frintrop, Gerschede, Schoenebeck and Vogelheim (ZIP codes 45355, 45356, 45357 und 45359). The act of notarization usually has to take place in this very administrative district (except "particular legitimate interests of the clients demand acting beyond"), this regulation does apply for any german civil law notary, the object of the notarization can be located everywhere.
